Question by DonB: Ever hear this about so called “DUI” drivers?
I have heard this more than once, Sheriff says on TV. ” A car went left of center and smashed into another car, killing 2, we are waiting on blood test results for alcohol before we press charges on the driver of the car that went left of center”. Sober or not that driver killed 2 people, what is the need to find if .08 or not? I have never driven drunk, but I do know right from wrong.

Specific charge will vary depending on if they were legally over the limit in some states.

Because the the same accident with alcohol involved is a more serious offense.
Drunk driving is a crime, Police investigate crime. It is only one factor in their investigation.
It probably makes a difference as to the charges that are filed
Because if they are driving drunk they can be charged with a DUI and vehicular manslaughter. Other wise, just the murder.

Yes, it could have been wrong, but there’s a difference of being sober and being drunk or high at the time. It’s just to see the matter of the situation, what the circumstances are for a higher or lesser sentence.

that’s what the sheriff is waiting for — which charge to make. [Plus, if the driver was injured or seen at the ER, if the sheriff waits until he's discharged, the bill goes to the driver whereas if the sheriff charges him now, the hospital bills go to the government.]
If you are DUI you can be charged with murder, otherwise it could be vehicular manslaughter or just manslaughter, both of which carry a lessor penalty than murder.
It is because you have to make sure the driver was unimpaired. People texting on the cell phone(s) and looking for CD’s drive just like a person under the influence. A person could have been looking down at their cell phone or down at the floor board if the cruise control and crossed the center line. People multitask all the time in their vehicles. DUI resulting in the death can result into a different charge cause you were breaking the law which resulted in the death of another.
