If You Think That the Court Might File a Petition to Revoke on Dui Probation Is It Ok to Ask?

Question by Gail Gardner: if you think that the court might file a petition to revoke on dui probation is it ok to ask?
Ok I’m on dui probation from back in march with a suspended sentence for 1 year in oklahoma and last tuesday i got out of jail for public intox in another county? i also have a driving under revoke ticket 2 weeks before that they never filed on. but i’m scared they will file too revoke. i have reported everything too my po and she said that the court has too decide on what too do. also i was suposed to get a drug and alcohol evaluation in 30 days that i haven’t got done. my question is really will they file and if so will i likely get a full year. if i do get time will it be like 30 days cause i’m still new on probation. i am scared.
i also asked my po if i would know in a couple of days if the court was gonna file a revoke and she just said it would take a while. any way i hate the waiting and not knowing

My suggestion would be to get the drug and alcohol evaluation asap. Do whatever you need to do so it looks better to the court. I have gotten DWI’s etc in the past and my lawyers have always told me to do whatever has to be done so it “looks good on my behalf when I go to court”. Like I’m trying to change. Whether you are or not just do what ever they told you to do.
In your case they will most likely file. Once in the legal system it is hard to ever get free.

1. Get the evaluation
2. Seek out a councilor
3. Don’t drink/drug
4. Stay out of trouble
5. Be on your best behavior all the time.
